Service Agreement

Scope of Driveway Snow Service:

Fargo Snow will commence driveway snow clearing activities after a triggering snowfall (as determined by service level chosen above). Official snowfall to determine service will be the amount reported by FMweather.com. Fargo Snow will remove snow from the driveway, not within 2’ of garage doors or other obstacles. Additional cleanings will be provided during prolonged, heavy snowstorms. The timing of service visits will vary depending upon the timing of the snow. The contractor shall be permitted to provide snow service at any time of the day or night. If road conditions are unsafe due to a Blizzard or severe storm, service may be delayed to ensure our employee safety. Often times city snow plows fill driveway aprons with excess snow after driveways have been cleared. If this causes a hazard or inconvenience, kindly contact us and we will clear this within a reasonable time frame. No sidewalk service or hand shoveling is Included in Driveway Snow Service.

 

Scope of City Sidewalk Snow Service:

Fargo Snow will commence City Sidewalk snow clearing activities after a triggering snowfall (as determined by service level chosen above). Official snowfall to determine service will be the amount reported by FMweather.com. Fargo Snow will remove snow from the City Sidewalks only. Private walks and entryways are not included. Service maybe be at any time on the day or night. City Sidewalk Services are performed AFTER Driveway Service routes are completed by a separate team.

 

Scope of Detail Service:

Detail service includes shoveling in front of the garage door and from the garage door to the front door of the house. No other entryways or other private walks are included in the standard Detail Service. This Detail Service is performed by our sidewalk crew at the same time as City Sidewalk service. Must also sign up for City Sidewalk Service.

 

Additional Services:

Additional services requested by the customer may be done at an additional charge (ex: request for cleaning when vehicle is moved, snow hauling, or salting services.)

 

Snow Storage Locations:

Fargo Snow will clear snow from the driveway area to any permissible area nearby. Customer should clearly mark with stakes any area they do not want snow placed prior to the season. No hauling of snow is included.

 

Scope of De-icing:

De-icing material/application not included. Fargo Snow assumes no liability for slip and fall accidents.

 

Property Damage:

The Owner will report in writing, any property damage caused by the contractor within 48 hours. Fargo Snow will repair any timely and properly reported property damage as soon as reasonably possible. Fargo Snow will have no obligation for any property damage not timely and properly reported.

 

Obstructions:

If driveway is blocked by vehicles or other items, Fargo Snow will only clear unobstructed areas. If called back after an obstruction is moved, an additional fee will be charged.

 

Limitation of Liability:

Fargo Snow will exercise reasonable care to avoid damage to pavement, curbs, trees and shrubs. However, the contractor is not responsible for any: A) Damage to landscaping caused by the piling/storage of snow. B) Normal wear and tear on driveway caused from snow removal equipment. C). Damage to items that are snow-covered or not visible. D) Personal injuries resulting from slip and fall accidents.

 

Indemnification:

The Owner shall indemnify, defend and hold harmless the contractor, its owners, employees and subcontractors from and against any and all claims, damages, reasonable attorney’s fees and costs which the contractor incurs as a result of a claim or claims brought by the owner or any third party, arising out of any wrongdoing, negligence and/or breach of contract by the owner alleged or otherwise, or any Act of God, including but not limited to extraordinary weather conditions, that is related, in any manner whatsoever to premises or the owner’s involvement with the premises or the services, including but not limited to personal injuries resulting from slip and fall accidents.

 

Changes to Property:

This agreement has been agreed upon based on the customer’s property as it exists on the agreement date. If property changes are made Fargo Snow shall not be responsible for the maintenance of additional areas.

 

Hazards:

The contractor shall not be held responsible for any damages caused to articles left in the snow removal area, including property moveable and immoveable, including, but not limited to water valves, asphalt/concrete in poor condition, low hanging tree branches, garbage cans, recycling bins, basketball hoops, downspouts, plant pots, toys, extension cords, etc…, please be sure to remove all items from driveway. Customer is aware that snow blowing service may not clear their property to bare pavement and that slippery conditions may prevail even after service. Customer is aware that equipment is a hazard and will instruct residents to stay a safe distance away from Fargo Snow equipment when working.

 

Provision for Default and Cancellation:

In the event of cancellation, the customer will be responsible for all costs of services. There will be no refunds issued for unused time or services set forth by this agreement for customer cancelation. In the event of sale of the client’s house, this contract will not be canceled or refunded, but may be transferred to the new occupants. In the event the customer moves, this contract will not transfer to the new address.

 

Changes to Laws/Ordinances:

In the event the Government imposes rules/regulations or city ordinances that impact the cost of doing business for snow removal companies, Fargo Snow retains the right to add a surcharge to invoices for snow removal that is proportionate to the extra costs incurred by such government mandates or laws.

 

Payment:

Payment for the season is due in full to be on our service route. Checks must be made to Fargo Snow. A service charge of $30.00 will be charged for any returned check. Purchasers will be responsible for all costs of collection to collect any amount owed under this agreement.

 

Driveway Staking:

Customer agrees to allow Fargo Snow to put up driveway markers before the season begins. Please do not move or remove driveway markers. Fargo Snow will not service a driveway if the markers have been removed. Markers remain the property of Fargo Snow and Fargo Snow will remove them at the end of the season. Fargo Snow reserves the right to charge homeowner $20.00 if stakes and markers not returned in the spring.
